How should I prepare a power of attorney for translation and use abroad?

For a power of attorney, content, legal form and translation belong together. Clarify these requirements before signing or translating a version.

The short answer

Ask the overseas recipient about the required wording, signature format and language. Agree legal-form questions with the competent authority or notary. Translation renders the text; it does not automatically make an unsuitable power effective or replace required notarisation or authentication.

Start with agreed wording

Record the authorised person, intended transaction and recipient. Have any required draft legally agreed before creating several language versions.

The Federal Foreign Office distinguishes authenticity from compliance with legal-form requirements. Do not use translation as a substitute for checking the required form of the power.

Plan signatures and additional confirmations

Ask whether the recipient requires a particular notarial format or additional authentication. Agree the sequence with the issuers so later confirmation pages are not missed from the translation scope.

If you cannot sufficiently understand the text at the notarial appointment, also clarify interpreting needs. Written translation and oral communication during the appointment are separate preparation items.

Translate an identifiable final version

Clearly identify drafts and signed versions. Report changes before completion so a translation of outdated wording is not combined with a newly signed power.

Check names, company details and attachments against the final source. Agree issued copies and deadlines using the set actually confirmed.

Your next steps

  1. Clarify the recipient and required wording.

  2. Agree legal form and signature arrangements.

  3. Gather the final version and additional confirmations.

  4. Agree translation and issued copies.

More questions

Does translation create a legally effective power of attorney?

Translation renders existing wording. Clarify form and effectiveness with the competent legal professional or authority.

Can a draft be translated?

That can be agreed. Label it as a draft and discuss later alignment with the final version.

Do I need an interpreter as well?

Clarify this separately with the office involved in any signing or notarial appointment.
